Supreme Court Justice Bernard Turner will decide this morning whether the Kofthe Goodman murder trial will proceed.
On Friday, the attorney for the man alleged to have killed 11-year-old Marco Archer was on his feet for just under two hours trying to convince the judge why the trial against his client should not proceed.
The trial is expected to begin today.
Thirty-eight year-old Goodman is accused of murdering Marco back in September 2011.
The Columbus Primary student went missing on September 23 and was found on September 28 in bushes behind a Yorkshire Street apartment in Cable Beach.
His attorney, Geoffrey Farquharson, said there was so much pre-trial publicity concerning this matter and as a result his client would not get a fair trial.
Describing that publicity as inaccurate, misleading, and sensational, Mr. Farquharson said there is no question that the matter has touched anyone who may be in the jury pool.
He said that the publicity has been so extreme, clearly wrong and misleading that it is also malicious.
The attorney further told the judge that he could direct the jury to only be concerned about what is presented in court and not what they hear or see in the media, but he has to be assured that there is no risk in doing that.
He said you cannot subject a man to trial if you feel there is a risk he would not have a fair trial.
Lead Prosecutor, Neil Braithwaite disagreed.
He said if you depend on news written on the internet and by other means, then anyone can come up with a defence to say that they would not have a fair trial.
Mr. Braithwaite also said that a distinction must be made between reputable media outlets and people carrying cell phones.
The matter will begin at 9:30a.m.
