The child sex trial of Kofhe Goodman was delayed Tuesday until May 2014 after it was revealed that one of the jurors was related to the mother of the accuser.
The matter, which was being heard before Senior Justice Jon Isaacs, was adjourned after the justice learned that one of the jurors was related to the defendant.
Justice Isaacs discharged the jury of six women and three men with thanks and said the court has to ensure that justice is not only done but that justice be seen to be done.
He added that under the circumstances, no objective observer would be satisfied that something untoward was going on.
Lead Prosecutor Garvin Gaskins then tried to secure an early date for the retrial.
He noted that the victim is transitioning from the traumatic experience and is being forced to relive what happened.
However, Justice Isaacs said that due to a full calendar of cases through 2013, the earliest date he could set was May 12, 2014.
Goodman, 38, stands accused of kidnapping and unlawful sex with a minor.
Prosecutors claim that the Yorkshire Drive resident on August 17, 2011 abducted a 12-year-old boy from Augusta Street and then sodomised him.
On Monday, the boy, now 13-years-old, testified that Goodman, who also uses the name Elvardo Ferguson, forced him into his car, drove him to his Yorkshire Drive, Cable Beach condominium and then raped him.
Darell Taylor and Kristan Stubbs are the members of the prosecution’s team while Goodman is being represented by Attorney Geoffrey Farquharson.
Goodman is also expected to stand trial next year for the sexual assault and murder of 11-year-old Marco Archer.
